Terms & Conditions

Effective date: 11 October 2026
These Terms & Conditions govern your access to and use of JaNee. Please read them carefully before creating an account, purchasing a subscription or using the service.

1. Acceptance of These Terms

By creating a JaNee account, accessing or using JaNee, or purchasing a JaNee subscription, you agree to these Terms & Conditions and acknowledge our Privacy Policy.

If you use JaNee on behalf of a company, close corporation, partnership or other organisation, you confirm that you have authority to use the service on its behalf and to bind that organisation where applicable.

If you do not agree to these Terms, you should not create an account, purchase a subscription or use JaNee.

2. Eligibility

JaNee is intended for adults managing personal or business information. You must have the legal capacity required under applicable law to enter into these Terms.

If you are using JaNee for an organisation, you must also have the authority necessary to provide information and perform actions on behalf of that organisation.

3. What JaNee Provides

JaNee is an organisational management tool designed to assist individuals and businesses in recording and monitoring assets, requirements, renewal dates, expiry dates and related information.

Depending on your account, subscription and available features, JaNee may provide reminders, renewal history, cloud synchronisation, document and photograph attachments and other organisational tools.

Important: JaNee assists you with organising information. It does not take over your personal, legal, regulatory, contractual, insurance, licensing, financial or business responsibilities. You remain responsible for determining what requirements apply to you, verifying the information recorded in JaNee and completing all required actions before the applicable deadlines.

4. JaNee Is Not Professional Advice

JaNee does not provide legal, tax, accounting, insurance, regulatory, compliance, financial or other professional advice.

Information, calculations, statuses, reminders or other output displayed by JaNee should not be treated as a substitute for professional advice or confirmation from the relevant authority, regulator, insurer, contracting party or service provider.

You are responsible for determining the laws, regulations, licences, permits, registrations, insurance requirements, policies, contracts and other requirements applicable to you, your household or your business.

5. Your Responsibility for Deadlines

You remain responsible for monitoring and meeting your legal, regulatory, contractual, insurance, licensing, registration, renewal, service and other personal or business deadlines.

You should independently verify important dates and should not rely on JaNee as your only record, calendar or reminder of a deadline.

A requirement shown as current, due soon, overdue or otherwise categorised by JaNee is based on information stored in the service and does not constitute confirmation from any regulator, authority, insurer or other third party.

6. Reminders and Notifications

JaNee may provide reminders and notifications as a convenience. Delivery of any particular reminder or notification is not guaranteed.

Notifications may be affected by device settings, permissions, operating-system restrictions, incorrect or incomplete information, software behaviour, service availability or technical failures.

You must not rely solely on a JaNee reminder or notification to meet an important deadline.

7. Accuracy of Information

JaNee generally relies on information entered, selected or supplied by users. You are responsible for ensuring that information stored in your account is complete, accurate and kept up to date.

JaNee is not responsible for consequences arising solely from inaccurate, incomplete, outdated or misleading information supplied by a user, subject always to rights and remedies that cannot lawfully be excluded.

8. Account Registration and Security

You must provide accurate information when creating an account and keep your account information reasonably current.

You are responsible for maintaining the confidentiality of your login credentials and for taking reasonable steps to prevent unauthorised access to your account and device.

You must notify us promptly if you reasonably suspect that your account or credentials have been compromised.

You may not knowingly allow another person to use your credentials in a manner that compromises the service or circumvents account, subscription or security restrictions.

9. Personal and Business Workspaces

JaNee may offer different workspace types, including Personal and Business workspaces. Features available to a workspace may depend on the workspace type and subscription plan.

Business features are intended for legitimate business and organisational use. A person creating or administering a business workspace confirms that they have appropriate authority to do so.

10. Information About Other People

You are responsible for information you enter into JaNee, including information concerning family members, employees, customers, contractors, contacts or other people.

Where information relates to another person or organisation, you confirm that you have the authority, permission or other lawful basis required to store and process that information through JaNee.

Business users remain responsible for complying with applicable privacy, employment, record-keeping and other legal obligations concerning information they place in JaNee.

11. Documents, Photos and User Content

Where JaNee allows you to upload documents, photographs, notes or other content, you retain ownership of your content and responsibility for it.

You must not upload content that is unlawful, malicious, infringing, fraudulent, defamatory or that you do not have the right or authority to store or use.

You grant Platinum Milling (Pty) Ltd a limited, non-exclusive right to host, store, process, reproduce, transmit and otherwise technically handle your content only to the extent reasonably necessary to operate and provide JaNee, comply with law and protect the service.

This permission does not transfer ownership of your content to us.

12. Important Records and Backups

Although we take reasonable measures to operate and protect JaNee, you should not treat the service as the sole permanent repository for documents or information that you are legally, personally or operationally required to retain.

You should maintain appropriate independent copies or backups of critical records where necessary.

13. JaNee Plans

JaNee may offer Free, Personal and Business plans. The exact features, limits and availability of each plan are displayed in JaNee or through the applicable application marketplace.

Free plan

The Free plan may include limited use of JaNee without a paid subscription. Current limits may include a maximum number of assets or requirements and restrictions on certain features such as attachments.

Personal plan

The Personal plan provides additional features intended primarily for individual use, including up to 10 assets, up to 10 requirements per asset, attachments, renewal history, reminders and cloud synchronisation.

Business plan

The Business plan provides paid functionality intended for business use and may include the Personal plan functionality together with business workspace functionality and additional business features made available by JaNee.

We may improve, add to or modify plan features over time. Material changes affecting an existing paid subscription will be handled in accordance with applicable law and marketplace requirements.

14. Paid Subscriptions

Personal and Business plans may be offered as automatically renewing monthly or annual subscriptions.

Before purchasing, you will be shown the applicable subscription product, billing period and price through JaNee and/or the application marketplace handling the transaction.

Prices may vary by country, currency, tax treatment, marketplace and other factors. The price presented by the applicable marketplace before you confirm a purchase is the applicable purchase price, subject to mandatory law.

Unless otherwise stated at purchase, a paid subscription gives you access to the applicable paid features for the subscription period while the subscription remains valid.

15. Automatic Renewal

Paid subscriptions automatically renew unless cancelled in accordance with the applicable application marketplace's subscription rules.

If you purchase a monthly subscription, the marketplace may charge you for each successive monthly subscription period until the subscription is cancelled.

If you purchase an annual subscription, the marketplace may charge you for each successive annual subscription period until the subscription is cancelled.

The applicable marketplace controls the timing and processing of renewal charges and may provide its own notices before renewal as required by its rules or applicable law.

16. Subscription Billing

Mobile subscriptions are processed through the application marketplace from which the applicable subscription is purchased, such as Apple App Store, Google Play or Huawei AppGallery.

The marketplace may collect payment, applicable taxes and other information required to process the transaction.

Your purchase is also subject to applicable marketplace payment and subscription terms.

JaNee may receive transaction and subscription information necessary to verify your purchase and determine the features to which your account is entitled.

17. Cancelling a Subscription

You may cancel an automatically renewing subscription through the subscription-management facilities provided by the marketplace through which you purchased it.

Cancelling normally stops future renewal charges. Unless applicable law or marketplace rules provide otherwise, you may continue to have access to paid features until the end of the subscription period for which payment has already been successfully processed.

Uninstalling JaNee, signing out of JaNee or ceasing to use the service does not by itself cancel an active subscription.

18. Account Deletion and Subscriptions

Deleting your JaNee account does not necessarily cancel an active subscription purchased through Apple App Store, Google Play, Huawei AppGallery or another marketplace.

If you have an active paid subscription and wish to stop future billing, you should cancel that subscription through the applicable marketplace.

Account deletion may permanently remove the JaNee account to which subscription benefits were associated. You should manage your marketplace subscription before deleting your account where appropriate.

19. Failed Payments, Grace Periods and Subscription Expiry

If a subscription payment fails, is reversed, refunded, revoked or otherwise ceases to provide a valid paid entitlement, access to paid JaNee features may be restricted, suspended or returned to the Free plan as permitted by applicable marketplace rules and law.

A marketplace may provide a billing retry period, grace period or similar status. Paid access during such a period may depend on the entitlement information supplied or verified through the applicable marketplace.

20. Upgrades, Downgrades and Plan Changes

The timing and billing treatment of upgrades, downgrades and other subscription changes may depend on the marketplace through which the subscription was purchased.

If your account returns to the Free plan and contains more assets or requirements than the Free plan currently allows, JaNee may prevent you from adding additional items until your usage is within the applicable limit or you subscribe to an eligible paid plan.

Existing information will not be deleted solely because your account exceeds a Free-plan quantity limit following a downgrade, unless deletion is requested by you, required by law or otherwise permitted under these Terms for a separate reason.

Existing attachments are not intended to be automatically deleted solely because a paid subscription ends. However, functionality for adding new attachments or using other paid features may become unavailable while the account is on a plan that does not include those features.

21. Restore Purchases

Where supported by the applicable marketplace and platform, JaNee may provide functionality to restore or re-verify eligible purchases.

Restoration depends on valid marketplace purchase information and does not create a paid entitlement where no valid eligible purchase exists.

22. Refunds

Subscription purchases made through Apple App Store, Google Play or Huawei AppGallery are generally subject to the refund processes, rules and decisions of the marketplace that processed the transaction.

Please see our Refund & Cancellation Policy for further information about cancellations, refunds and marketplace purchases.

Nothing in these Terms limits any refund, cancellation, cooling-off or other consumer right that cannot lawfully be excluded under applicable law.

23. Subscription Price Changes

Subscription prices may change from time to time.

Where an existing subscription price changes, any required notice, consent or other procedure will be handled in accordance with applicable law and the rules of the marketplace through which the subscription is billed.

24. Taxes

Prices displayed by an application marketplace may include or exclude taxes depending on the country, marketplace and applicable law.

The marketplace processing the transaction may calculate, collect and remit applicable taxes in accordance with its arrangements and legal obligations.

25. Availability of the Service

We aim to keep JaNee available and functioning reliably, but continuous or uninterrupted availability cannot be guaranteed.

JaNee may occasionally be unavailable or degraded because of maintenance, upgrades, internet or infrastructure failures, security incidents, third-party service interruptions, marketplace issues, circumstances beyond our reasonable control or other technical problems.

We may modify, maintain, update or temporarily suspend parts of the service where reasonably necessary.

26. Geographic Availability

JaNee may be made available in multiple countries and regions, but this does not mean that every feature, subscription, marketplace or service is available in every location.

We may restrict, delay or discontinue availability in a country or region where reasonably necessary because of legal, regulatory, technical, marketplace, security or operational requirements.

27. Third-Party Services and Marketplaces

JaNee relies on third-party technology and service providers for functions including authentication, databases, storage, email, operating-system functionality, application distribution and subscription processing.

Third-party services and marketplaces may be governed by their own terms, policies and privacy practices.

We are not responsible for independent acts, omissions, outages or decisions of third parties outside our reasonable control, subject to applicable law.

28. Acceptable Use

You may not use JaNee to:

29. Intellectual Property

JaNee, its branding, software, website, designs, interfaces, text and other service materials are owned by or licensed to Platinum Milling (Pty) Ltd and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of JaNee or our intellectual property to you.

Subject to these Terms and your applicable subscription, we grant you a limited, non-exclusive, non-transferable and revocable right to use JaNee for its intended purpose.

30. Suspension and Restriction

We may reasonably restrict or suspend access to JaNee where necessary to protect the service or its users, investigate suspected fraud or abuse, address security threats, comply with law, respond to invalid or revoked subscription entitlements or address a material breach of these Terms.

Where reasonably practicable and legally permitted, we will endeavour to act proportionately having regard to the nature of the issue.

31. Account Deletion

You may permanently delete your JaNee account through the functionality provided in the application.

If you cannot access the JaNee app, you may also request account deletion through our Delete Account page.

Account deletion is permanent and may result in deletion of personal or business records, attachments and other information associated with the account.

You are responsible for retaining copies of information you need before deleting your account.

Certain information may be retained where required or permitted by applicable law, for security or fraud-prevention purposes, or for the establishment, exercise or defence of legal claims, as described further in our Privacy Policy.

As explained above, account deletion and marketplace subscription cancellation are separate actions.

32. Warranties and Consumer Rights

We will provide JaNee with the level of care and skill required by applicable law.

Except for warranties, rights or remedies that cannot lawfully be excluded or limited, JaNee is provided on an "as available" basis and we do not warrant that every feature will always be uninterrupted, error-free or suitable for every user's particular personal, business, legal or compliance requirements.

Nothing in these Terms excludes, limits or waives any mandatory right, warranty, remedy or protection available to you under the Consumer Protection Act 68 of 2008 of South Africa or other applicable consumer law.

33. Limitation of Liability

Please read this section carefully. It limits certain liabilities of Platinum Milling (Pty) Ltd in connection with JaNee, but only to the extent permitted by applicable law. Nothing in this section excludes liability or consumer rights that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, Platinum Milling (Pty) Ltd will not be responsible for loss or damage to the extent caused by:

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special or consequential loss where such liability may lawfully be excluded, particularly where the loss was not reasonably foreseeable or was not caused by a breach of an obligation for which we are legally responsible.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence where such liability cannot lawfully be limited, death or personal injury where exclusion is prohibited, or any other liability that applicable law does not permit us to exclude or limit.

34. Claims Arising From Your Use or Content

To the extent permitted by law, you are responsible for claims, losses or expenses resulting from your unlawful use of JaNee, your infringement of another person's rights, or content you knowingly provide without the necessary rights or authority.

This provision does not require you to compensate us for loss caused by our own unlawful conduct, negligence or breach where applicable law places responsibility on us.

35. Privacy

Our processing of personal information is described in the JaNee Privacy Policy.

36. Changes to JaNee and Plan Features

JaNee will continue to develop. Features may be added, improved, replaced or discontinued over time.

We may also change Free-plan limits or the features associated with future subscription offerings.

Where a change materially affects an existing paid subscription or your legal rights, we will take steps required by applicable law and marketplace rules, including providing notice where required.

37. Changes to These Terms

We may update these Terms to reflect changes to JaNee, subscriptions, applicable law, marketplace requirements, security requirements, service providers or our business operations.

The effective date displayed at the top of this page identifies the current version.

Where required by law or appropriate having regard to the nature of a material change, we may provide additional notice or request renewed acceptance.

38. Electronic Communications

Subject to applicable law, account-related notices and communications may be provided electronically through JaNee, email, our website or another appropriate electronic method.

You are responsible for keeping the email address associated with your JaNee account current.

39. Apple-Specific Terms

If you obtain JaNee through Apple's App Store, you acknowledge that these Terms are between you and Platinum Milling (Pty) Ltd, not Apple, and that Platinum Milling (Pty) Ltd is responsible for JaNee and its content, subject to these Terms and applicable law.

Your use of JaNee must comply with the applicable App Store usage rules. Apple has no obligation to provide maintenance or support services for JaNee except to the extent required under applicable law or Apple's own policies.

To the extent required by the applicable App Store terms, Apple and its subsidiaries are third-party beneficiaries of these Terms in relation to your use of the Apple-distributed version of JaNee and may enforce the relevant provisions against you.

40. Other Application Marketplaces

If you obtain JaNee through Google Play, Huawei AppGallery or another authorised marketplace, your use of that marketplace and transactions processed by it are also subject to its applicable terms and policies.

Nothing in these Terms is intended to override mandatory marketplace terms or consumer protections that lawfully apply to your transaction.

41. Severability

If a provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted, limited or severed to the minimum extent reasonably necessary and permitted by law without affecting the validity of the remaining provisions.

42. No Waiver

A failure or delay by us to enforce a provision of these Terms does not automatically constitute a waiver of that provision or our right to enforce it later.

43. Governing Law and Consumer Protections

These Terms are governed by the laws of the Republic of South Africa, subject to mandatory laws that apply regardless of this choice of law.

Subject to mandatory consumer rights and jurisdictional rules that apply to you, disputes concerning these Terms or JaNee may be dealt with by a court or other competent forum having lawful jurisdiction in South Africa.

If the law of the country or region in which you reside gives you mandatory consumer rights, remedies or rights to bring proceedings in a local court or forum that cannot lawfully be restricted by these Terms, those rights are not affected by this section.

44. Entire Agreement

These Terms, together with the JaNee Privacy Policy and any additional terms expressly presented for a particular feature, subscription, promotion or service, constitute the agreement governing your use of JaNee in relation to their subject matter.
